1. Agreement to Terms

By accessing or using Zeebot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

Zeebot is an AI-powered chatbot platform that enables businesses to create, train, and deploy conversational AI assistants on their websites. The Service includes:

  • AI chatbot creation and configuration tools
  • Document upload and training capabilities
  • Embeddable chat widgets
  • Conversation management and analytics
  • Team collaboration features
  • Integration capabilities

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. Subscription and Payments

4.1 Subscription Plans

The Service offers various subscription tiers with different features and limits. Plan details and pricing are available on our website and may change with notice.

4.2 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed through Stripe using the payment method you provide
  • You authorize us to charge your payment method for all fees incurred
  • All fees are exclusive of taxes, which may be added where applicable

4.3 Refunds

Subscription fees are non-refundable except as required by law or at our sole discretion. If you cancel your subscription, you will retain access until the end of your current billing period.

4.4 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the next billing cycle, and excess resources may be automatically deactivated.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any laws, regulations, or third-party rights
  • Transmit harmful, offensive, or objectionable content
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any systems
  • Use the Service for spam, phishing, or fraudulent activities
  • Create chatbots that provide medical, legal, or financial advice without appropriate disclaimers
  • Train chatbots on content you don't have rights to use
  • Reverse engineer, decompile, or attempt to extract source code
  • Resell or redistribute the Service without authorization

6. Your Content

6.1 Ownership

You retain ownership of all content you upload, create, or transmit through the Service ("Your Content"), including documents, chatbot configurations, and business information.

6.2 License Grant

By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display Your Content solely for the purpose of providing and improving the Service. This license ends when you delete Your Content or close your account.

6.3 Responsibility

You are solely responsible for Your Content and represent that you have all necessary rights to upload and use it. We do not review or endorse Your Content and are not liable for any claims arising from it.

7. AI and Chatbot Output

You acknowledge and agree that:

  • AI-generated responses may contain errors or inaccuracies
  • Chatbot outputs should not be relied upon as professional advice
  • You are responsible for reviewing and monitoring chatbot responses
  • You should implement appropriate disclaimers for your end-users
  • We do not guarantee specific outcomes from using AI chatbots

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Zeebot and protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written consent.

We respect intellectual property rights and expect users to do the same. We may terminate accounts of repeat infringers.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Third-Party Services

The Service integrates with third-party services (such as OpenAI for AI processing and Stripe for payments). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEEBOT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

14. Indemnification

You agree to indemnify and hold harmless Zeebot and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting us or using the account settings. Data retention after termination is governed by our Privacy Policy.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through the Service. Your continued use after changes become effective constitutes acceptance of the new Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of European Union, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of European Union.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zeebot regarding the Service and supersede any prior agreements.
